Terms of Service
Effective date: [EFFECTIVE DATE] Last updated: [EFFECTIVE DATE]
These Terms of Service ("Terms") govern your use of the Packworthy website at packworthy.app and its pages, guides, waitlist and email features (together, the "Site"). The Site is operated by [LEGAL ENTITY], doing business as AutoOps ("Packworthy," "we," "us," or "our"), located at [MAILING ADDRESS].
Use of the Packworthy mobile apps is governed by our separate App Terms of Use. Our Privacy Policy explains how we handle personal information.
Please read Section 13 (Dispute Resolution) carefully. Except where prohibited by law, it requires individual arbitration and waives class actions and jury trials.
1. Accepting these Terms
By using the Site, creating a Site account, signing up for a guide, or joining the waitlist, you agree to these Terms. If you do not agree, do not use the Site.
2. Who can use the Site
You must be at least 18 years old (or the age of majority where you live, if higher) to create an account, sign up for email, or join the waitlist. The Site is intended for adults planning travel. It is not directed to children, and we do not knowingly collect personal information from children.
3. Accounts and sign-in
Some guides are available only after you sign up with your email address or sign in with Google. You agree to give accurate information, keep your sign-in secure, and tell us at [CONTACT EMAIL] if you think someone else is using your account. You are responsible for activity under your account. If you sign in with Google, Google's terms and privacy policy also apply to that sign-in, and we receive only the information described in our Privacy Policy.
4. Guides and content
The Site offers packing guides, checklists, calculators and related content ("Content"). Content is general information for planning purposes only.
- No guarantees. Packing suggestions, quantity estimates (including diaper, wipe and baby-supply estimates), weather information and travel tips may be incomplete or wrong. You are responsible for deciding what to pack and for checking current rules with your airline, cruise line, airport, border authority or other travel provider.
- Not professional advice. Content is not medical, health, safety, legal or travel-agency advice. For medication, infant feeding, allergies or health conditions, ask a qualified professional.
- Third-party names. References to third-party brands, parks, cruise lines or products are for identification only. Packworthy is not affiliated with or endorsed by Disney, any cruise line, or other third parties named on the Site unless we say so.
5. Waitlist and emails
If you join the waitlist, we will email you about the Packworthy launch and related updates. If you sign up for guides or opt in to marketing, we may send you emails about Packworthy, new guides, features and offers, as described in our Privacy Policy. Every marketing email includes an unsubscribe link, and we honor unsubscribe requests promptly (and within 10 business days). You can also unsubscribe by emailing [CONTACT EMAIL]. Unsubscribing from marketing does not stop service-related messages, such as account or security notices. Joining the waitlist does not guarantee access, pricing or a launch date.
6. Affiliate links, advertising and app purchases
App purchases. The Site does not sell plans. Packworthy plans are bought in the App through Apple or Google and are governed by our App Terms of Use. Annual plans renew automatically until cancelled. We do not issue refunds directly: refund requests go to, and are decided by, the app store you bought from, under its policies. This does not affect any rights you have under consumer laws that cannot be waived, including EU/UK withdrawal rights for digital content.
The Site may contain affiliate links and advertising. If you buy something through an affiliate link, we may earn a commission at no extra cost to you. See our Affiliate Disclosure. We do not control third-party products, sellers, prices or websites and are not responsible for them. Your purchases from third parties are between you and that third party.
7. Acceptable use
You agree not to:
- copy, scrape, crawl, or bulk-download the Site or Content, except as permitted by standard search-engine indexing or our robots.txt;
- republish, sell, or commercially exploit Content without our written permission;
- interfere with, overload, probe, or bypass security of the Site;
- create accounts with false information or by automated means, or share gated Content in a way intended to bypass sign-up;
- use the Site to violate any law or anyone's rights; or
- upload or send malware, spam, or unlawful content.
8. Intellectual property
The Site, the Content, and the Packworthy name, logos and designs are owned by us or our licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to view and use the Site and Content for your own non-commercial travel planning. You may print or save a copy of a guide for personal use. All other rights are reserved.
9. Feedback
If you send us ideas or feedback, you allow us to use them without restriction or payment to you.
10. Third-party services
The Site uses third-party services, such as sign-in, analytics, advertising, email delivery and weather data providers. Their services are governed by their own terms. We are not responsible for third-party services or websites.
11. Disclaimers
THE SITE AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
Some jurisdictions do not allow certain warranty disclaimers, so some of the above may not apply to you. If you are a consumer in the EU, UK or another country with mandatory consumer protections, nothing in these Terms limits your statutory rights.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, OR FOR ITEMS FORGOTTEN, LOST, CONFISCATED OR NOT PACKED, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF US$50 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
These limits do not apply to liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, fraud, or gross negligence or willful misconduct where those limits are prohibited.
13. Dispute resolution
13.1 Informal resolution. Before filing a claim, you agree to email [CONTACT EMAIL] with a description of the dispute and try to resolve it informally for 60 days.
13.2 Arbitration (U.S. users). If we cannot resolve the dispute informally, you and we agree that any dispute arising out of or relating to these Terms or the Site will be resolved by binding individual arbitration administered by [ARBITRATION PROVIDER] under its consumer rules, except that either party may bring an individual claim in small-claims court, and either party may seek injunctive relief for infringement of intellectual property. The arbitration will take place in [ARBITRATION VENUE] or by video, and the Federal Arbitration Act governs this Section.
13.3 Class-action and jury waiver. YOU AND WE AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING, AND YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL.
13.4 Opt-out. You may opt out of this arbitration agreement by emailing [CONTACT EMAIL] within 30 days after you first accept these Terms, with your name, email address, and a clear statement that you opt out of arbitration.
13.5 Users outside the U.S. If you live in the EU, UK or another country where pre-dispute arbitration of consumer claims is not enforceable, Sections 13.2 to 13.4 do not apply to you, and you may bring claims in the courts of the country where you live. EU consumers may also use the EU's online dispute resolution resources.
14. Governing law and venue
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws rules, except that the Federal Arbitration Act governs Section 13. Subject to Section 13, claims will be brought exclusively in the state or federal courts located in [COUNTY], California, and you and we consent to their jurisdiction. If you are a consumer outside the U.S., you also keep the protection of the mandatory laws of the country where you live.
15. Termination
We may suspend or end your access to the Site or your account if you break these Terms or if we stop offering the Site. You may stop using the Site at any time and may delete your account as described in our Privacy Policy. Sections that by their nature should survive termination will survive.
16. Changes to these Terms
We may update these Terms. If a change is material, we will give notice on the Site or by email before it takes effect. Continuing to use the Site after the effective date means you accept the updated Terms. Changes will not apply retroactively to disputes we already know about.
17. General
These Terms, together with the Privacy Policy and any terms referenced here, are the entire agreement between you and us about the Site. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates a partnership, agency, or employment relationship.
California users: Under California Civil Code Section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
